These Terms and Conditions ("Terms") govern your access to and use of the RadRoster mobile application ("App"), operated by Aria Infotech Pty Ltd (ACN 696233931) ("we", "us", "our"). By accessing or using RadRoster, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Definitions and Interpretation
In these Terms, unless the context otherwise requires:
- "App" means the RadRoster mobile application available on iOS and Android platforms.
- "Professional" means a user registered as a radiology professional (Radiologist, Sonographer, Radiographer, or Nurse).
- "Business" means a user registered as a radiology practice, imaging centre, or employer.
- "User" means any person who accesses or uses the App, whether as a Professional or Business.
- "Content" means any information, data, text, images, profiles, job listings, messages, or other materials uploaded, posted, or transmitted through the App.
- "Services" means the job marketplace, networking, messaging, and related services provided through the App.
- "AHPRA" means the Australian Health Practitioner Regulation Agency.
- "Ad Credits" means the virtual credits used by Businesses to promote job listings within the App.
2. Acceptance of Terms
By creating an account or using RadRoster, you acknowledge that you have read, understood, and agree to be bound by:
- These Terms and Conditions;
- Our Privacy Policy; and
- All applicable Australian laws and regulations.
We reserve the right to modify these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the modified Terms.
3. Eligibility and Account Registration
3.1 General Eligibility
To use RadRoster, you must:
- Be at least 18 years of age;
- Have the legal capacity to enter into binding contracts;
- Reside in Australia or be legally authorised to work in Australia; and
- Provide accurate, current, and complete information during registration.
3.2 Professional Accounts
If registering as a Professional, you must:
- Be a qualified radiology professional (Radiologist, Sonographer, Radiographer, or Nurse);
- Hold current and valid registration with AHPRA (where applicable);
- Provide your AHPRA registration number and other professional credentials;
- Maintain active registration throughout your use of the App; and
- Immediately notify us if your registration is suspended, cancelled, or subject to conditions.
3.3 Business Accounts
If registering as a Business, you must:
- Be an authorised representative of a legitimate radiology practice, imaging centre, or healthcare employer;
- Have the authority to bind the Business to these Terms;
- Provide accurate business details including ABN/ACN (if applicable); and
- Comply with all employment laws and regulations when posting jobs or engaging professionals.
3.4 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials;
- All activities that occur under your account;
- Notifying us immediately of any unauthorised access or security breach; and
- Ensuring your account information remains accurate and up to date.
We are not liable for any loss or damage arising from your failure to protect your account credentials.
4. User Conduct and Prohibited Activities
4.1 Acceptable Use
You agree to use RadRoster only for lawful purposes and in accordance with these Terms. You will not:
- Violate any applicable laws, regulations, or third-party rights;
- Provide false, misleading, or inaccurate information;
- Impersonate any person or entity;
- Harass, threaten, or abuse other users;
- Upload or transmit viruses, malware, or other harmful code;
- Attempt to gain unauthorised access to the App or other users' accounts;
- Scrape, data mine, or use automated systems to extract data from the App;
- Reverse engineer, decompile, or disassemble any part of the App;
- Use the App for any commercial purpose not expressly permitted by these Terms;
- Post spam, unsolicited advertisements, or fraudulent content; or
- Interfere with the proper functioning of the App.
4.2 Professional Integrity
Professionals must:
- Maintain professional standards and ethical conduct;
- Accurately represent their qualifications, experience, and availability;
- Not misrepresent their AHPRA registration status;
- Comply with all professional codes of conduct and regulatory requirements; and
- Not use the App to engage in any conduct that would breach their professional obligations.
4.3 Business Integrity
Businesses must:
- Post only genuine job opportunities;
- Provide accurate job descriptions, requirements, and compensation;
- Comply with all employment laws including fair work, anti-discrimination, and workplace health and safety legislation;
- Not use the App to collect personal information for purposes other than legitimate recruitment;
- Respect the privacy and confidentiality of applicants; and
- Not post discriminatory, misleading, or fraudulent job listings.
5. Job Listings and Applications
5.1 Job Postings
Businesses may post job listings for radiology positions. By posting a job, you represent and warrant that:
- The job opportunity is genuine and currently available;
- All information provided is accurate and complete;
- The job complies with Australian employment laws;
- You have the authority to recruit for the position; and
- You will not discriminate unlawfully in your recruitment practices.
5.2 Applications
Professionals may apply for jobs posted on the App. By applying, you:
- Authorise the Business to view your profile and contact you;
- Represent that your profile information is accurate and current;
- Acknowledge that we are not involved in the recruitment or employment process; and
- Agree that any employment relationship is directly between you and the Business.
5.3 No Employment Relationship
RadRoster is a platform that connects Professionals and Businesses. We are not:
- An employer, recruitment agency, or labour hire provider;
- A party to any employment or service agreement between users;
- Responsible for verifying job listings, qualifications, or references;
- Liable for any disputes, injuries, or issues arising from employment relationships; or
- Obligated to facilitate, monitor, or mediate employment arrangements.
6. Messaging and Communications
6.1 In-App Messaging
Users may communicate directly through the App's messaging feature. You agree that:
- Messages must be professional, respectful, and relevant to job opportunities;
- You will not send spam, harassment, or inappropriate content;
- We may monitor messages to ensure compliance with these Terms;
- We may remove or disable messaging for users who violate these Terms; and
- Messages are not encrypted end-to-end and should not contain highly sensitive information.
6.2 Third-Party Communications
Any arrangements made outside the App (via phone, email, or in person) are solely between you and the other party. We are not responsible for such communications or any resulting agreements.
7. Ad Credits System
7.1 Purchase and Use
Businesses may purchase Ad Credits to promote job listings. By purchasing Ad Credits, you agree that:
- Ad Credits are non-refundable except as required by Australian Consumer Law;
- Ad Credits have no cash value and cannot be exchanged for money;
- Ad Credits may expire as specified at the time of purchase;
- We may modify pricing, features, or availability of Ad Credits at any time;
- Payment is processed through secure third-party payment providers; and
- All purchases are final unless the App fails to deliver the advertised service.
7.2 Promotional Features
Ad Credits may be used to:
- Boost job listings to appear higher in search results;
- Feature jobs in prominent positions within the App; or
- Access other promotional features as made available.
We do not guarantee specific results, applicant numbers, or hiring outcomes from promoted listings.
8. Intellectual Property
8.1 Our Intellectual Property
All intellectual property rights in the App, including software, design, trademarks, logos, and content, belong to Aria Infotech Pty Ltd or our licensors. You may not:
- Copy, modify, reproduce, or distribute any part of the App;
- Use our trademarks, logos, or branding without written permission;
- Create derivative works based on the App; or
- Remove or alter any copyright, trademark, or proprietary notices.
8.2 User Content
You retain ownership of Content you upload to the App. By posting Content, you grant us a worldwide, non-exclusive, royalty-free licence to:
- Use, display, reproduce, and distribute your Content within the App;
- Modify or adapt Content for technical or operational purposes; and
- Use aggregated, anonymised data for analytics and service improvement.
You represent that you have all necessary rights to grant this licence and that your Content does not infringe third-party rights.
9. Privacy and Data Protection
Your use of RadRoster is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles.
By using the App, you consent to our collection and use of personal information as described in the Privacy Policy.
10. Disclaimer of Warranties
To the maximum extent permitted by law:
- The App is provided "as is" and "as available" without warranties of any kind;
- We do not warrant that the App will be uninterrupted, error-free, or secure;
- We do not verify the accuracy, qualifications, or credentials of users;
- We do not endorse, guarantee, or assume responsibility for any job listings, profiles, or user conduct;
- We make no warranties regarding the suitability, reliability, or availability of the Services; and
- You use the App at your own risk.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Competition and Consumer Act 2010 (Cth) or other applicable consumer protection laws.
11. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the App;
- Our total liability to you for any claims arising from these Terms or your use of the App is limited to the amount you paid to us (if any) in the 12 months prior to the claim;
- We are not responsible for employment disputes, workplace injuries, professional negligence, or any issues arising from user interactions;
- We are not liable for losses caused by third-party services, internet connectivity, device compatibility, or user error; and
- We do not guarantee job placement, hiring success, or any specific outcomes from using the App.
These limitations apply even if we have been advised of the possibility of such damages and regardless of the legal theory asserted.
12. Indemnification
You agree to indemnify, defend, and hold harmless Aria Infotech Pty Ltd, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of the App;
- Your violation of these Terms;
- Your violation of any laws or third-party rights;
- Content you post or transmit through the App;
- Employment relationships or disputes with other users; or
- Any negligent or wrongful conduct on your part.
13. Termination and Suspension
13.1 Termination by You
You may terminate your account at any time by:
- Deleting your account through the App settings; or
- Contacting us at hello@radroster.com.au.
Termination does not entitle you to a refund of any fees or Ad Credits.
13.2 Termination by Us
We may suspend or terminate your account immediately, without notice, if:
- You breach these Terms;
- You engage in fraudulent, illegal, or harmful conduct;
- Your AHPRA registration is suspended, cancelled, or subject to conditions (for Professionals);
- We receive complaints of harassment, discrimination, or unprofessional behaviour;
- We are required to do so by law or regulatory authority; or
- We decide to discontinue the App or Services.
13.3 Effects of Termination
Upon termination:
- Your access to the App will be revoked;
- Your profile, job listings, and messages may be deleted;
- Unused Ad Credits will be forfeited without refund;
- You remain liable for any obligations incurred prior to termination; and
- Provisions that by their nature should survive termination will continue to apply.
14. Dispute Resolution
14.1 Informal Resolution
Before commencing legal proceedings, you agree to first attempt to resolve any dispute by contacting us at hello@radroster.com.au and negotiating in good faith.
14.2 Governing Law and Jurisdiction
These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland and any courts hearing appeals from those courts.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aria Infotech Pty Ltd regarding the App.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
15.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms without restriction.
15.5 No Agency
Nothing in these Terms creates a partnership, agency, employment, or joint venture relationship between you and Aria Infotech Pty Ltd.
15.6 Force Majeure
We are not liable for any failure to perform our obligations due to events beyond our reasonable control, including natural disasters, strikes, internet outages, or government actions.
15.7 Third-Party Services
The App may integrate with or link to third-party services (e.g., payment processors, cloud hosting). We are not responsible for third-party services, and your use of them is subject to their own terms and policies.

17. Consumer Law Notice
Under the Australian Consumer Law, certain consumer guarantees apply to goods and services. Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable consumer protection legislation.
If you are a consumer within the meaning of the Australian Consumer Law, our liability for breach of a consumer guarantee that cannot be excluded is limited, at our option, to:
- In the case of services: supplying the services again or paying the cost of having the services supplied again; or
- In the case of goods: replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of having the goods repaired or replaced.
